A business wanted to hire an individual who was currently sponsored by another organisation.  The individual’s contract included non-compete clauses and the organisation did not have a licence to sponsor migrant workers.

We provided holistic advice on the immigration and employment factors affecting the individual’s right to work for the business as well as strategic advice on the process and timing for becoming a licensed sponsor in order to obtain work permission for the individual to work for the business.

We provided detailed advice on the documentary requirements and process for applying for a sponsor licence, including advising on sponsorship duties.  When UKVI arranged a pre-licence inspection, we provided urgent additional advice on compliance duties and attended the inspection to provide support.  Once the licence was approved we then assisted the business with assigning a Certificate of Sponsorship and with the individual’s Tier 2 application to work for the business, which was successful.
