Charity Commission investigations

Charity Commission inquiries and regulatory compliance cases

We have acted on some of the most significant Charity Commission investigations of the past decade including statutory inquiries into the closure of Kids Company and the management of safeguarding matters by a major overseas aid agency.

We know that a Charity Commission investigation can be a difficult experience for a charity and its trustees and staff, and take account of any reputational, relational and financial concerns in the advice and support that we provide.

How we help

If you are facing a Charity Commission investigation, we can guide you through the process and possible outcomes including interim manager appointments, action plans, official warnings, trustee disqualification and the recovery of funds.

We help with:

  • Gathering information and documents requested in a Charity Commission investigation and advising on any related data privacy and Freedom of Information Act 2000 issues.
  • Working with you to prepare a response to the Charity Commission’s enquiries.
  • Supporting you in meetings and interviews with the Charity Commission investigation meetings.
  • Managing internal and external communications and publicity, working as appropriate with other advisors.
  • Assisting with the implementation of a Charity Commission action plan or other regulatory advice and guidance, including by undertaking independent reviews into governance, safeguarding or other issues which have arisen.
  • Advising on whether a Charity Commission decision or proposed disqualification order is challengeable and assisting with this process.

We will tailor our advice to your circumstances and, where relevant, draw on the expertise of our multidisciplinary team of charity, dispute resolution, tax, fraud, regulatory, safeguarding, employment, data privacy and media law experts.
