I support both employers and employees on a range of contentious and non-contentious issues, across the whole life cycle of an employment relationship, from advising on issues of employment status, to the handling of dismissals or negotiating an agreed exit.
I have experience drafting a broad spectrum of employment related documents, such as employment contracts, settlement agreements, suites of workplace policies, and recognition agreements with trade unions. I advise on the handling of workplace procedures including grievances, disciplinaries, as well as redundancies and performance management. I manage a varied caseload of litigation and have experience in the Employment Tribunal and appellate courts.
I enjoy combining technical expertise with creative thinking and pragmatism to best advise clients on (often complex) scenarios, bearing in mind the commercial and reputational rationale behind a desired outcome, balanced against any associated risks.
- Advising on the resolution of a long-running dispute, in respect of a grievance and appeal brought by a senior director against members of the senior management and HR.
- Providing technical and strategic advice on industrial relations matters, including inducement claims and trade union recognition processes (voluntary and statutory).
- Successfully resisting an appeal against the Registrar’s Order at the Employment Appeal Tribunal and a further application to the Court of Appeal on a longstanding discrimination claim.
- Collaborating with Charity & Social Enterprise colleagues to advise on the handling of disciplinary measures in conjunction with Serious Incident Reporting, in the context of media attention and regulatory scrutiny.
- Advising an executive board on Tribunal proceedings in Scotland, involving allegations of whistleblowing. Over twenty heads of claim were withdrawn during case management, and the few remaining were settled before trial.
