International data transfers can be complex, confusing and convoluted. But they are the backbone of international trade, especially in a post-Brexit landscape. In this Masterclass, we work through a fictionalised scenario to identify the main issues relating to data transfers and make sure the correct mechanisms are put in place.
After a short recap of the legislative framework, we will consider key questions such as:
- Are the territories to which the data is being sent adequate or do we need to put a transfer mechanism in place?
- Is there anything that might bring us in scope of EU GDPR?
- Do we need to complete a Transfer Risk Assessment?
- How extensive does our Transfer Risk Assessment need to be?
- Can we rely on exceptions to the transfer rules?
We take a pragmatic approach, providing participants with our key takeaways based on our extensive experience in advising on these issues. By the end of the session, participants will be better able to:
- identify the most suitable transfer mechanisms;
- navigate the relevant templates;
- conduct a risk assessment which is proportionate to the risks, saving time and resource.
